You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting customer care. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.
All the terms and conditions and/or any transactions occurring online at www.picturesplus.com or by phone are subject to the laws of the State of Hawaii. Pictures Plus is not responsible for the delay and/or damages resulting from Machinery Breakdown, Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo. The tools available on www.picturesplus.com to create files is the property of Pictures Plus and its affiliated companies. The Buyer’s order shall be deemed an acceptance of the Seller's terms. The Terms and conditions shall in all respects be governed by STATE OF HAWAII law.
Customers may upload personal images and content to be printed via our website. By uploading content, you warrant that you own all rights to the images or have the legal right to reproduce and print the content. Pictures Plus reserves the right, at its sole discretion, to refuse to print or process any content that we deem to be unlawful, offensive, explicit, defamatory, or otherwise inappropriate for production or distribution. We also reserve the right to reject content that may infringe on the intellectual property rights of others or violate applicable laws. Pictures Plus is not liable for any customer-uploaded content and disclaims all responsibility related to its use, printing, or public display.
Due to the nature of the product, no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. The replacement of the order will take place only after the defect, damage, or shortage as been confirmed by our customer service team. We may require receipt of returned merchandise before proceeding with the replacement order. We will not replace the order if it is determined by us that the order was misused or mishandled by the buyer.
If the Buyer's credit card is declined, Pictures Plus will not process the Buyer’s order. If the order is shipped and should the Buyer's account become delinquent, Buyer agrees to pay a monthly finance charge of 2% (annual percentage rate of 24%) on the unpaid balance. If an account goes beyond the payment term's due date, unless specific arrangements are made, future purchases will require advance payment. In the event that Pictures Plus must commence legal action to enforce any terms of this agreement, the Buyer agrees to pay reasonable legal fees and costs.
Pictures Plus neither makes any explicit warranty nor implies or accepts any responsibility other than possible replacement of damaged, defective, or missing products that Buyer purchased through our site. At Pictures Plus’ discretion, we may replace the defective product or credit the amount of the purchase price.
Shipping terms are F.O.B. origin. Pictures Plus will arrange for shipping with the carrier on behalf of the Buyer. The Buyer will be fully responsible for the shipping and handling costs. Pictures Plus will not be responsible for delay in delivery, loss or damage of the order once it is in the custody of the shipping carrier or thereafter.
To the fullest extent permitted by law, Pictures Plus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, arising out of or related to the use of, or inability to use, our website, products, or services—whether in contract, tort (including negligence), strict liability, or otherwise—even if we have been advised of the possibility of such damages.
Pictures Plus makes no warranties or representations, express or implied, regarding the content, operation, or availability of this site or any services provided. All products and services are provided “as is” without warranties of any kind, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose.
You agree that your sole and exclusive remedy for any claim against Pictures Plus arising from your use of the site or products shall be limited to the amount you paid, if any, for the product or service in question.
All designs, templates, tools, and content provided by Pictures Plus are the exclusive property of Pictures Plus and its affiliates. Customers must ensure any uploaded content does not infringe upon third-party intellectual property rights. By submitting content to Pictures Plus, the customer agrees to indemnify and hold harmless Pictures Plus against any legal claims related to infringement or unauthorized use.
Orders may not be cancelled once they have entered processing. No refunds will be issued for orders that have been printed, shipped, or are in production. If an order is mistakenly placed, please contact customer service immediately, and we will do our best to accommodate your request before processing begins.
